Brett M. D'Spain
I began work in the real estate development and entitlement business in Phoenix, Arizona during the mid-1970’s working on numerous residential and commercial projects in Chandler, Tempe, Mesa and Apache Junction. I was transferred to Durango, Colorado in 1979 to manage a large recreational subdivision in La Plata County. In addition to assisting the sales team, I was responsible for upgrading facilities, managing new infrastructure construction and management of a metropolitan district that provided central water, central sewer, road maintenance and fire protection to the 1,800 acre subdivision. When the sales campaign ended in the early 1980’s, I continued to manage the metropolitan district for several years. During my tenure with the district, the water supply system was improved and simplified, water and sewer was extended to nearby residential development, district maintenance and fire equipment was upgraded and the volunteer fire department merged with Upper Pine River Fire Protection District to improve efficiency and lower costs.
In the late 1980’s I began real estate consulting work for a local law firm representing the Pagosa Lakes Property Owner’s Association in its lawsuit against Fairfield Communities, Inc. over the ownership of greenbelt and other open space areas within the former Pagosa Lakes subdivision. This consulting work led to several years work in the legal field. In 1995 I began working for Dugan & Associates in Durango which specialized in real estate, litigation and oil and gas. In addition to my paralegal duties with this firm and working under the supervision of Thomas P. Dugan, Esq., I conducted due diligence investigations, project entitlements and permitting for wide range of private parties and corporations, including oil and gas clients of the firm. I assisted Mr. Dugan in obtaining project entitlements for the Durango Wal-Mart Supercenter, worked on Wal-Mart’s Cortez and Montrose Supercenters, assisted with project entitlements for the Durango Home Depot store, obtained all project entitlements for Escalante Partners, LLC, the developers of Escalante Crossing Planned Development, a 44 acre mixed use development in Durango and obtained all necessary state and local entitlements and permits for Mid-America Pipeline’s Rocky Mountain Loop pipeline project from Bloomfield New Mexico to Brown’s Park, Utah. The firm and I also worked on County permitting for oil and gas facilities located in La Plata County, Colorado.
